Terms of Service

By accessing thewarwagon.com or any of our online services (the “Service”), creating an account, placing an order, or using our mobile lounge booking forms, you agree to be bound by these Terms of Service. You also represent that you are at least twenty-one (21) years of age. If you do not agree, do not use the Service.

We may update these Terms going forward. Updates apply prospectively (see Section 18). Your continued use of the Service after an update is your agreement to the updated Terms.

The Service is operated by War Wagon Cigar Lounge, LLC(“War Wagon,” “we,” “us,” or “our”), a Texas limited liability company formed in 2023.

To create an account you must be at least twenty-one (21) years old and provide accurate, current information. You are responsible for keeping your password secure and for everything that happens under your account.

Tell us at info@thewarwagon.com right away if you suspect any unauthorized use of your account or any other breach of security. You remain responsible for activity under your account until we have a reasonable opportunity to act on your notice.

We may suspend or close your account at any time for any reason, including violations of these Terms or applicable law. You may close your account at any time by emailing us.

All cigars and other tobacco products sold on the Service are restricted to buyers who are at least twenty-one (21) years of age. You represent that you meet that requirement and that you are not purchasing on behalf of anyone who does not.

Before we accept any order containing tobacco products, we electronically verify your age and identity through AgeChecker.Net, our third-party age-verification provider. AgeChecker.Net cross- references the information you provide against public records to confirm you are at least twenty-one (21). If the electronic verification fails or cannot be completed, we will cancel the order and refund any charge.

Tobacco shipments are sent via United States Postal Service with the USPS Adult Signature Restricted service (Service 921), which requires an adult 21 or older to sign for the package at delivery. The carrier will not release the package to anyone under 21 or leave it without a signature.

Buying tobacco products for anyone under 21 is illegal and is grounds for immediate account closure and reporting to law enforcement.

Prices on the Service are in U.S. dollars and may change without notice. We strive to keep product descriptions, prices, and inventory accurate, but we do not warrant that information on the Service is free of errors. We may correct typographical errors and reserve the right to refuse or cancel any order, including orders accepted in error or with incorrect pricing.

Your placement of an order is an offer to buy at the listed price. Our acceptance of the order occurs only when payment is successfully processed. If we charge your payment method and then discover an error, our sole obligation is to issue a full refund.

Sales tax is added where required by state and local law, including on Operatives membership fees and Nomad subscription charges.

Operatives is the War Wagon Cigar Lounge membership program. We currently offer five tiers:

All membership fees are listed before sales tax. Texas sales tax is added to your monthly charge.

• Reserve ($10 / month, in-lounge): early access to new cigar releases, invitations to Operative-only events, and the member rate on house perks.
• Covert ($50 / month, in-lounge): all Reserve benefits plus a 10% discount on products, a free cigar cutter on signup, and a Cigar of the Month.
• Keystone ($75 / month, in-lounge): all Covert benefits plus a 15% discount, a free cigar lighter on signup, and a VIP punch card with redeemable visit rewards.
• Nomad ($50 / month, subscription): a monthly mystery box of cigars, swag, and accessories shipped to your door or held for pickup at the Orange lounge. Detailed terms in Section 7.
• Business($250 / month, 3-month minimum commitment, then month-to-month): two named business members on one business account, one assigned member locker, in-lounge ad space on War Wagon partner screens, priority access to sponsorship opportunities, free admission for named members to ticketed War Wagon events, 10% off products including alcohol, preferred pricing on mobile lounge bookings and private in- lounge gatherings, and preferred group cigar pricing for client appreciation nights, team outings, and business events. Membership benefits apply to the named users and business account only and are not company-wide. Ad creative must be supplied by the business in the required format and runs in War Wagon's standard ad rotation. Sponsorship opportunities are based on availability and fit. Discounts and preferred pricing cannot be combined with other promotions unless specifically approved.

Tiers, prices, and specific benefits are described in detail on the Operatives page. Membership benefits are personal to the member, are not transferable to anyone else, and have no cash value.

Entitlements: the free cutter (Covert) and free lighter (Keystone) are one-time-per-membership benefits that you redeem at the lounge. Our staff will mark each as redeemed in your account.

Reserve and ticketed events: Reserve membership does not include free admission to ticketed events. Operative- only events listed in your account are included with active membership at the eligible tier.

Program changes. We reserve the right to add, change, or discontinue specific benefits prospectively. If we make a material change that adversely affects a benefit you have already paid for in a given membership month, we will give you a reasonable choice between continuing under the new terms or canceling for a prorated refund of that month.

Sealed liquor at the lounge. War Wagon Cigar Lounge, LLC holds a Texas Alcoholic Beverage Commission BG-200154320 permit for the sale of beer, wine, and mead. We do not sell liquor. As a courtesy to members in good standing, we allow sealed-bottle liquor to be brought into the lounge as a BYOB house privilege, subject to all applicable Texas law and the lounge house rules. Sealed liquor cannot remain in the lounge overnight. We do not provide bottle service, sell liquor, or allow outside beer or wine.

The Nomad subscription is a recurring monthly mystery box of cigars, swag, and accessories with a retail value of $50 to $75. The subscription price is $50 per month, charged automatically to the payment method you have on file. Shipping within states we serve is included; you may also choose to pick up your box at the Orange lounge at no additional charge.

Charity. $1 from every Nomad drop is donated to Operation: Cigars for Warriors. The running total is published on the Charity page.

Cancellation.You can cancel your Nomad subscription at any time from your account page in a single click. Cancellation takes effect immediately and prevents future monthly charges. If a monthly charge has already processed for the current cycle, that month's box still ships - the charge was for the box, not the month.

Pause. You can pause your subscription for up to ninety (90) days at a time from your account page. While paused, you are not charged and do not receive a box. You can resume at any time during the pause, and the next charge schedules from the resume date.

Skip a month.Within a single click in your account, you can skip the current month's drop without canceling or pausing the subscription. Skipped months are not charged.

Rate the drop. After each drop, you can rate the cigars in your account. We use your feedback to curate future drops.

Failed payments. If a recurring charge fails, we will email you and attempt the charge again. After multiple consecutive failures we will pause the subscription automatically. We will not ship a box for a cycle that was not paid.

Price changes. We will notify you by email at least thirty (30) days before any price change to a subscription you already have. You can cancel before the new price takes effect.

Gift subscriptions. Nomad is also available as a one-time prepaid gift subscription in three, six, or twelve- month lengths. Gift subscriptions are not recurring and do not auto-renew. The recipient must be at least 21 years old and will complete age verification at the time the first gift box is processed.

Nomad-tenure VIP. After six (6) consecutive paid months as a Nomad subscriber, you become a Nomad-tenure VIP. VIP perks include free shipping on shop orders, exclusive drops, and early access to new releases. VIP status persists for as long as you remain an active Nomad subscriber and is separate from the paid Keystone tier.

Loyalty points - earn. You earn one (1) loyalty point for every one dollar ($1) spent on eligible product purchases. Eligible product purchases means the product subtotal of an order (or the in-lounge equivalent). The following are not eligible for points earning: sales tax, shipping, gift cards, donations, tips, refunded purchases, Operatives membership fees, Nomad subscription charges, and anything else we specifically exclude in the loyalty rules as published on the Service.

Loyalty points - redeem. Every one hundred (100) loyalty points redeems for five dollars ($5) off an eligible purchase. Eligible purchases include cigars, accessories, swag, and in-lounge alcohol purchases. Loyalty points may not be applied to sales tax, shipping, Operatives membership fees, Nomad subscription charges, gift cards, or donations.

Loyalty points - other terms. Loyalty points have no cash value outside the Service, may not be transferred to another account, and are not your property in any intellectual-property sense. We do not currently expire unused points; we may forfeit points held in an account that is closed, refunded against the underlying purchases, or that we reasonably determine has abused the program. We may adjust earn rates and redemption value prospectively and will give you reasonable notice in your account before changes take effect.

Referrals. When you refer a friend with your personal referral code and that friend completes their first paid purchase, both of you receive a ten-dollar ($10) credit toward future purchases. The credit to the friend is applied automatically at their first checkout. The credit to you posts to your account after their first paid purchase clears. We may close any account that abuses the referral program (creating fake accounts, self-referrals, etc.) and reverse credits issued through abuse.

Where we ship. At launch we ship to Texas only. We are working through state-by-state research and licensing and will enable additional states on the Service as each clears. The states we can ship to are listed at checkout. We do not and will not ship to Utah or Hawaii. We do not ship internationally.

How we ship. Our default tobacco carrier is the United States Postal Service using the USPS Adult Signature Restricted service (Service 921). We may use other carriers for non-tobacco accessories. Risk of loss and title to the products pass to you when our carrier takes possession of the package. We will help you file a carrier claim if a package is lost, stolen, or damaged in transit. Order processing time. Standard processing is one to two (1 to 2) business days between order placement and handoff to the carrier. Orders placed on weekends and federal holidays begin processing the next business day.

Shipping rates. Shop orders are calculated at checkout based on order weight and destination. Shop orders with a product subtotal of one hundred and forty-nine dollars ($149) or more ship free within the continental United States via our standard carrier. The Nomad subscription includes shipping in its monthly price.

Pickup at the lounge. If you select pickup, your order is held at the Orange storefront for fourteen (14) days from the date we notify you that it is ready. Bring a photo ID at pickup. If your order is not picked up within the 14-day window, we will cancel it and charge a restocking fee of fifteen percent (15%) of the order subtotal before refunding the remainder. Contact us if you need an extension before the window expires.

Tobacco products. Tobacco products are not eligible for return once they have left our facility, for safety and quality reasons.

Non-tobacco merchandise. Cutters, lighters, swag, and other accessories may be returned unopened within fourteen (14) days of delivery, subject to a fifteen percent (15%) restocking fee deducted from the refund.

Damaged or wrong orders. If your order arrives damaged, miscounted, contains the wrong product, or is otherwise not as ordered, contact us within fourteen (14) days of delivery and we will make it right at our expense. No restocking fee applies to our errors or carrier damage.

Refund timing. Once we approve a refund, we process it on our end the same business day or the next. The time between our processing and the credit appearing on your card or bank statement is controlled by your card issuer or bank and typically takes seven to ten (7 to 10) business days.

Alcohol at the lounge. War Wagon Cigar Lounge, LLC holds a Texas Alcoholic Beverage Commission BG-200154320 permit for the sale of beer, wine, and mead. Sealed-bottle liquor brought in by members is a BYOB house privilege described in Section 6 and the house rules. We do not allow outside beer or wine.

Large groups & private events. Walk-ins, including groups, are welcome. Unless you have reserved the lounge in advance, large groups should not expect the lounge to themselves. For private events or lounge reservations, please contact us directly at info@thewarwagon.com or 409-223-7252 to arrange.

Refusal of service. We reserve the right to refuse service or remove anyone from the lounge for any reason consistent with applicable law, including violating the house rules, being intoxicated, or being a danger or nuisance to other guests or to staff.

We offer two business-to-business intake paths through the Service.

Wholesale. If you are a licensed tobacco retailer interested in carrying War Wagon-affiliated brands, you can submit a wholesale inquiry. We will follow up with pricing, credit terms, and a separate wholesale agreement. The Service does not currently offer wholesale checkout; orders submitted through the consumer shop at wholesale-pretending pricing will be canceled.

Partnerships. If you are interested in in-lounge advertising or sponsorship of a mobile-lounge event, you can submit a partnership inquiry. We will follow up with available slots, rates, and a separate partnership agreement. The Service does not provide automated ad-serving or impression billing - partnership inquiries are handled out-of-band.

Either inquiry path may be removed or its terms changed at any time.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Scrape, crawl, or otherwise collect data from the Service in bulk, except through a standard web browser or search-engine indexing.
• Attempt to circumvent, disable, or interfere with any security feature or rate limiting on the Service.
• Use the Service to send unsolicited communications to anyone, or to harvest or store other users' contact information.
• Impersonate any person or entity, or misrepresent your affiliation with anyone.
• Upload or transmit malicious code or content that infringes the rights of others.

We may suspend or terminate access for any violation of this section.

The Service, including all text, photos, graphics, logos, brand marks (including “War Wagon Cigar Lounge” and the skull-and-stencil marks), and software, is owned by us or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. You may view and use the Service for your personal, non-commercial use only. You may not copy, reproduce, modify, distribute, or create derivative works from any of it without our prior written permission.

You may link to thewarwagon.com from another site as long as the link uses plain text or our approved brand mark, does not suggest endorsement or affiliation that does not exist, and does not appear in a context that misrepresents or disparages us.

If you submit a review, comment, photo, or other content to the Service (“User Content”), you keep your rights in that content but grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content in connection with the Service and our marketing of it. You represent that you have the right to grant that license. We may remove any User Content at any time.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR TRADE USAGE.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

Tobacco use carries serious health risks, including but not limited to addiction, cardiovascular disease, respiratory disease, and cancer. The U.S. Surgeon General's warnings on our products are part of those products for a reason. We do not warrant that any product is safe or fit for any particular purpose, and we make no health claims about any product we sell.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WAR WAGON CIGAR LOUNGE, LLC OR ITS OWNERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, THESE TERMS, OR ANY PRODUCT SOLD THROUGH THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless War Wagon Cigar Lounge, LLC and its owners, officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Service, your User Content, or your violation of any law or the rights of any third party.

These Terms are governed by the laws of the State of Texas without regard to its conflict-of-laws principles. The federal and state courts located in Orange County, Texas (or for federal matters, the United States District Court for the Eastern District of Texas, Beaumont Division) have exclusive jurisdiction over any dispute arising out of or relating to the Service or these Terms. You consent to personal jurisdiction and venue in those courts.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND WAR WAGON CIGAR LOUNGE, LLC EACH WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND WAR WAGON CIGAR LOUNGE, LLC EACH AGREE THAT ANY DISPUTE WILL BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

Before filing any claim against the other party, you and we agree to first attempt to resolve the dispute informally by contacting the other party in writing and giving them sixty (60) days to respond.

We may update these Terms from time to time. The “Last updated” date at the top of this page shows when the current version took effect. Updates apply prospectively. If a change is material, we will make reasonable efforts to notify you by email or via the Service.

Your continued use of the Service after an update is your agreement to the updated Terms. If you do not agree, your remedy is to stop using the Service and close your account.

Our Privacy Policy explains what information we collect from you, how we use it, and the choices you have. The Privacy Policy is incorporated into these Terms by reference.
